Thomas Arthur is scheduled for execution on July 31 in Alabama. The state is pursuing his execution even though his conviction was based mainly on the testimony of an admitted perjurer who had an incentive to lie at his trial. Although DNA evidence exists which Thomas Arthur says could help demonstrate his innocence, the State of Alabama has not granted his request to be allowed to conduct DNA testing of evidence relating to the crime. (from amnesty international usa)

Why is this not given to the guy, it is a question of life and death?

and

NO this is not about the death penalty; even if you are in favour you do not want innocent people to die
NO this is not against the US, I am just shocked that this can happen, no matter where

Sugar

Not to sound insensitive, but in Texas they sort of make a habit of this kind of thing.  To put it differently, we're used to it.

In Canada we give $6.5 Million in compensation for wrongful conviction of death row inmates..

There, in bold, is the operative statement. The convicted murderer says there is DNA evidence that could prove his innocence. Well, the US Supreme Court denied his appeal based on his claim that the death penalty amounts to cruel and unusual punishment, not based on any possible DNA evidence. This man has been awaiting his fate since 1982. That's 26 years of life that his victim didn't enjoy. Mr. Arthur is a two-time loser with a prior second degree murder conviction. He was tried and convicted three times for this murder. I won't shed any tears when he finally meets his maker.

Recently 16 death row inmates had to be released because DNA test showed their innocence. How do you know that Mr. Arthur is not no. 17?

The justice system, as any human institution, is imperfect.

That's life (and death).

This guy has had plenty of opportunity to prove his case.  He hasn't.

People read one side of the story (from the defendant) and the anti-capital punishment crowd on the internet and accept it all as fact.  What time have you spent reviewing the prosecutor's case?

Let me guess.  None!

Very few. And we all know that evryone convicted of any kind of crime is innocent, all you have to do is ask them, they will be happy to tell everyone they absolutely innocent of the charge s.

That's one of the reasons why the UK stopped the death penalty. Somehow saying 'sorry' after someone innocent has been executed just doesn't make it better.

I am afraid you are completly missing the point. I have no idea if he is innocent or not nor have I got an opinion about it. But there is DNA evidence. Before society kills someone, shouldnt they have taken all measures to make certain that they do not kill someone who could be innocent? All they need to do to be certain is run a simple test.

Did I get this right? We are discussing if somebody who could be innocent receives the death penalty and this is your comment?

This is so low, I have no words for it.

P.S. your alleged red arrow proves that I am right

You are assuming that they haven't "taken all measures" based on the statements of the defendant and the internet bloggers.

You missed the point.  You have no idea what the other side of the story is.
